1. Introduction
Welcome to The Eyesite (“The Eyesite,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our products, services, website, appointments, eyewear purchases, eye care consultations, and related services. By accessing our website, visiting our store, scheduling an appointment, or purchasing products from The Eyesite, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.
2. Eligibility
You must be at least 18 years of age to enter into a legally binding agreement with us. If you are under 18, a parent or legal guardian must provide consent and supervise your use of our services.
3. Products and Services
The Eyesite offers products and services including but not limited to:
● Prescription eyeglasses
● Sunglasses
● Contact lenses
● Lens upgrades and coatings
● Eye examinations (where applicable)
● Eyewear repairs and adjustments
● Optical consultations
All products and services are subject to availability.
4. Prescription Responsibility
Customers are responsible for ensuring that any prescription provided to The Eyesite is current, accurate, and issued by a licensed eye care professional.
We are not responsible for:
● Incorrect prescriptions provided by customers;
● Changes in vision occurring after an eye examination;
● Delays caused by verification of prescription information.
If a prescription appears incomplete, inaccurate, or expired, we may refuse or delay fulfillment until clarification is obtained.
5. Pricing and Payment
All prices are listed in Canadian Dollars (CAD) unless otherwise stated.
We reserve the right to:
● Modify prices at any time without notice;
● Correct pricing errors;
● Refuse transactions resulting from pricing inaccuracies.
Payment is due at the time of purchase unless alternative arrangements have been approved.
Accepted payment methods may include:
● Cash
● Debit cards
● Credit cards
● Other approved payment methods
6. Insurance Claims
Where applicable, customers are responsible for:
● Confirming their insurance coverage;
● Providing accurate insurance information;
● Understanding policy limitations and reimbursement requirements.
The Eyesite does not guarantee insurance reimbursement and is not responsible for denied claims.
7. Returns and Exchanges
Prescription Eyewear because prescription eyewear is custom-made, prescription products may be non-refundable except where required by law. If there is a manufacturing defect or dispensing error, we may repair, replace, or remake the
product at our discretion. Non-Prescription Products
Non-prescription items may be eligible for return or exchange within [30] days of purchase provided they:
● Are unused;
● Are in original condition;
● Include proof of purchase.
Refunds may be issued to the original payment method.
8. Warranty
Manufacturer warranties, if available, apply according to the manufacturer’s terms. The Eyesite may offer additional warranty coverage as described at the time of purchase.
Warranty coverage does not apply to:
● Normal wear and tear;
● Accidental damage;
● Improper use;
● Loss or theft.
9. Appointment Policies
Customers scheduling appointments agree to:
● Arrive on time;
● Provide accurate information;
● Notify us of cancellations or rescheduling requests as soon as possible.
Repeated missed appointments may result in limitations on future bookings.
10. Medical Disclaimer
Information provided by The Eyesite, whether online or in-store, is for general informational purposes only and is not a substitute for professional medical advice. Customers should consult a qualified optometrist, ophthalmologist, or healthcare professional
regarding any vision or medical concerns. If you experience a medical emergency, seek immediate medical attention.
11. Website Use
Users agree not to:
● Violate any applicable laws;
● Attempt unauthorized access to our systems;
● Upload malicious software;
● Interfere with the operation of our website;
● Use our content without authorization.
We reserve the right to suspend or terminate access for violations of these Terms.
12. Intellectual Property
All content associated with The Eyesite, including:
● Logos
● Branding
● Website content
● Images
● Graphics
● Text
● Marketing materials
is owned by or licensed to The Eyesite and is protected by Canadian intellectual property laws. No content may be copied, reproduced, or distributed without prior written permission.
13. Privacy
Your use of our services is also governed by our Privacy Policy. We collect, use, and disclose personal information in accordance with applicable Canadian privacy laws, including Alberta’s privacy legislation and the federal Personal Information Protection and Electronic Documents Act (PIPEDA).
14. Limitation of Liability
To the fullest extent permitted by law, The Eyesite shall not be liable for:
● Indirect damages;
● Consequential damages;
● Incidental damages;
● Loss of profits;
● Loss of business opportunities;
● Delays caused by manufacturers, suppliers, or third parties.
Our total liability arising from any claim shall not exceed the amount paid by the customer for the product or service giving rise to the claim.
15. Indemnification
You agree to indemnify and hold harmless The Eyesite, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, or expenses arising from:
● Your misuse of our services;
● Violation of these Terms;
● Violation of applicable laws.
16. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts
located in Alberta, Canada.
17. Changes to These Terms
The Eyesite may update these Terms from time to time.
Updated versions will become effective upon posting on our website or otherwise being made available to customers.
Continued use of our services constitutes acceptance of any revised Terms.
